Delivery Policy

You must be at least 21 years of age to purchase wine. ADULT SIGNATURE REQUIRED.

By placing your order you have represented to Zachys that you are at least 21. All alcoholic beverages that Zachys arranges for delivery on your behalf must be received and signed for by an adult of legal drinking age; this also includes items delivered outside of the United States.

Important Notice

Due to federal and state regulations, all wine deliveries must be received by an adult 21 years of age or older. An adult must be physically present to sign for the wine delivery. Therefore, Zachys recommends that you designate a business address. Federal regulations also make it illegal to deliver wine to post office boxes. Zachys cannot schedule deliveries for a specific time during the day.

Please Note - The time it takes to pull, assemble and process a typical order is approximately 3-5 business days prior to arranging for delivery. If your order is time sensitive, it is suggested you choose an expedited delivery option. Delivery dates are never guaranteed if sent via Ground service.

Please be advised that deliveries will NOT be held despite possible low or high temperatures in your area. Your purchase confirms authorization of immediate arrangement of delivery. To hold delivery for up to 90 days free of charge, please select “Store in Zachys climate-controlled warehouse” as your Order Option at checkout.

Special Handling: The removal of less than a full solid case or mix case from storage will incur a $25.00 per case/split charge regardless of the number of bottles. Please contact Customer Service with questions.

1% of the total purchase price will automatically be added to your order to cover any breakage or loss that may occur. In the case that you receive damaged merchandise, you must inform Zachys of any broken or damaged bottles within two days of delivery. A call tag will be issued to pick this up at a chosen location and once the merchandise is returned to Zachys, a replacement item(s) will be sent out. If you would like to decline this coverage please uncheck the acceptance box on the form. By waiving the coverage you relinquish Zachys of any and all responsibility of breakage or loss that may occur to your order. You may elect to have the original wood case shipped (if applicable) by noting this in "Special Instructions" upon submission of your order. This is a supplemental charge of $10 per case to ship via Ground service.

Please note that your delivery costs are estimated. Actual costs will be confirmed with you when your order is placed.

Place of Sale

Title to, and ownership of, all wine passes from seller to buyer in the State in which the sale occurs, and buyer takes all responsibility for the wine being transported from the state of sale to the buyers selected destination. By placing an order, buyer authorizes seller to act on buyer’s behalf in arranging for transportation of the wine at the buyer’s direction. Alternatively, buyer may choose to pick up the wine at seller’s location, or make independent delivery arrangements. Sales tax will be applied based on the seller’s location. Seller makes no representation as to the legal rights of anyone to deliver or import any wines, alcoholic beverages or other goods into any state. Buyer is solely responsible for the transport of wine and other goods purchased and for determining the legality and the tax/duty consequences of having the wine and other goods delivered to the applicable destination.

Zachys Policy on Consumer Transportation of Purchase Requirements

Zachys policy is to strictly observe all legal requirements on delivery that exist in New York and in other states. Zachys requires customers visiting its facilities in person, online, or who call via telephone, who buy wine and other items to either pick up their purchases at a licensed Zachys facility, or to have their purchases delivered to themselves under such legal rights as may exist (and such rights change regularly – consumers are strongly advised to know the requirements that apply to them) for them to take delivery of wine in the state or area in which they live. This legally permitted method of doing business involves the following steps (1) title legally (in accordance with the Uniform Commercial Code) transfers in the state of sale, where the goods are sold, (2) Zachys files tax reports in accordance with state law, and (3) the bill of lading shows the customer (who directs the process of either picking up his or her wine or having it delivered in accordance with the customer’s legal rights) as the party directing the delivery.
